Poolhallptr Terms Of Service

By signing up and actively using the Poolhallptr program you agree to all terms and conditions set forth in this agreement. Poolhallptr may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its affiliates. Affiliates will be informed of any and all changes to this policy via an e-mail to their primary contact e-mail address provided upon signing up with Poolhallptr. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the Poolhallptr program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.

ALL COUNTRIES WILL BE ALLOWED TO JOIN...HOWEVER ANY COUNTRIES THAT FALL UNDER "OTHER COUNTRIES" (THOSE NOT LISTED ON THE ACCEPTED COUNTRIES WILL BE ADS ONLY...THERE WILL BE NO PAYOUTS FOR "OTHER COUNTRIES"..AGAIN THOSE WILL BE ADS ONLY). ONLY THOSE MEMBERS WHO READ AND UNDERSTAND ENGLISH WILL BE ALLOWED!! READING TESTS WILL BE GIVEN ON A REGULAR BASIS!!
Responsibility of Affiliates:

You must be 18 years of age or older to participate in this program. Our program is open to both US and International affiliates and is void where prohibited by local governing laws.

You agree to and must use your own name and email address in the sign-up process and may not assume a false identity. Anyone signing up with gibberish in their information will be deleted. You may not sign-up multiple times with different email addresses. We allow one account per individual. There may be only one account per household. If we find out that a person has multiple accounts, we will be deleting all accounts without notice.

You will use your e-mail address or user name / password combination to access your account, it is your responsibility to keep this information confidential, you may change this information by logging into your account and following the "User Account Info." link. You are solely responsible for any and all use of your Poolhallptr account including authorization by you to any third party individual who may use your account.

Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by Poolhallptr be detected it may result in member termination and possible legal action. Any solicitation of advertisers for a confirmation e-mail for purposes of receiving credit in your account will be grounds for immediate termination.

You must maintain your e-mail account that you use for Poolhallptr . You agree to receive e-mail advertising from Poolhallptr with no more than 100 emails per day.

Accounts with bouncing email addresses will be put to onsite inbox.You may change the settings back after you fix the reason why your emails were bouncing. After the Third time your account could be deleted.This especially applies to e-mail accounts returned for being Full. Bouncing Emails is costly to the sites bandwidth and slows the server down. Any member sending us gibberish will result in automatic termination of your account and Forfeiture of All earnings to the date of termination. Auto-responses will also be deleted immediately. If you use the onsite inbox, you must still provide a valid email address that you CAN receive mails to from Poolhallptr. You may change your email account that you used when signing up at Poolhallptr . We understand the need at times to change Internet connections or email addresses.

The webmaster of Poolhallptr has the right to refuse advertising for sites that have unsustainable information on their site. All sites are reviewed before sending. Please see advertising page or redemptions page for sites not accepted. We will NOT refund any redemptions or paid advertising for advertising we do not accept.

Cheat Links And English Tests:

Cheat Links(visible and invisible) will be sent on a regular basis. They will have a warning above the cheat link. Its the members responsibility to read to avoid clicking it. If you click 3 cheat banners od email links your account will be deleted and you will lose all earnings and downlines!! No exceptions!! If you click the visible link 1 time, your account will be canceled and you lose your account and all downlines and earnings. No exceptions!!

English tests will be sent. It is the members responsibility to read the instructions completely. Failure to pass a reading tests will result in your account being suspended or deleted. This is Paid to Read email and that is what is expected of the members here.

All PTC sections may contain a Cheat Link/Banner(visible and invisible). Do Not Click on this Link/Banner (visible and invisible) (visible`s will be clearly Marked). These anticheat measures are there to monitor automated software users and non-english reading members which is against our Terms of Service.Your account will be reviewed and may be canceled without notice. You Lose All earnings up to the date of termination if you click it and are found to be cheating. No exceptions!!

FREE MEMBERS

Must log in every 15 days and be at least 30% as active as your downline to get commissions from downline clicks. Your account will be canceled and you Lose All earnings up to the date of termination for clicking links with no less than 35 clicks per month. This will be tracked in your accounts and on site.

UPGRADED MEMBERS

Must login every 60 days and be at least 30% as active as your downline to get commissions from downline clicks. Your account will be canceled and you Lose All earnings up to the date of termination for inactivity of more than 60 days. and as an upgraded member you must click no less than 15 links per month. These rules are a must for an active English reading membership so we can sell ads to advertisers.

Members are required to give full user information. Members are required to give full online payment information. Any member giving false payment ID information will have their account canceled instantly. Every Member MUST have their own individual payment id.It can`t be shared with other members. Please notify us via the contact page if and why your Paypal account is in someone elses name.

Keywords And Interests:

We have "bad" keywords/interests "Delete me, I cheat"(more could be added) this helps in finding the members that can't understand English and use auto signup bots. If your account is found to have one of these keywords selected your account will be canceled with no prior warning. If you are NOT from a search allowed country, do not select the SEARCH interest keyword - accounts from non search countries that have this keyword selected will be canceled.

Searches:

Only members from certain countries are allowed to participate in search emails. The countries allowed by "most" Search Engines are: United States, Canada, Australia, Belgium, Denmark, Finland, Germany, Italy, Netherlands, New Zealand, Portugal, Spain, Sweden and United Kingdom. All persons from countries not from the countries listed above who select "Searches" as a category of interest or found to be participating in "Searches" will have their account canceled and you Loose All earnings up to the date of termination.

**Deleted accounts will not be restored if canceled for any of the above system abuse rules**

Relationship of the Parties:

You and Poolhallptr are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and Poolhallptr . You understand that you do not have authority to make or accept any offers or make any representations on behalf of Poolhallptr . You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program.

Limitation of Liability:

Poolhallptr will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or Poolhallptr program, even if Poolhallptr has been advised of the possibility of such damages. Furthermore, Poolhallptr aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement. You must use your own judgement in joining any advertised programs.

Payments:

Affiliates may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the area on the website provided by Poolhallptr . Affiliates may earn by referring new affiliates to the Poolhallptr program. Affiliates will earn a percentage of advertising revenues collected by Poolhallptr.

Poolhallptr will pay affiliates when their balance reaches the minimum payout rate set by Poolhallptr. Once the member has reached payout they may request payment, by mailing through the contact page and requesting payout. Account will be verified and then members request will be placed in the payout que. You must meet all terms and site requirements to be paid. Members will be paid via PayPal /Redemptions/egold, but only when available. Payments will be made within 60 days or a reasonable time after.

Spam:

You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your affiliateship with Poolhallptr and may result in legal prosecution. Poolhallptr strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. Poolhallptr may charge up to $5 per spam e-mail sent. Multiple sign-ups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. Poolhallptr will file charges for recovery of any earnings received from multiple sign-ups.
